Welcome to Watchlist. These Terms of Service outline the rules and obligations that apply when you use our platform.

1. Acceptance of Terms

  • By accessing or using Watchlist (“Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
  • These Terms are a binding agreement between you and Watchlist.

2. Eligibility

  • You must be at least 13 years old to use Watchlist. If you are under the age where you live requires parental consent to process data, you must have that consent.
  • You represent that you are legally able to enter into these Terms.

3. The Service

  • Watchlist lets users rate, review, and discover online videos and creators, and may include profiles, rankings, leaderboards, comments, and messaging.
  • We may add, change, or remove features at any time.

4. Accounts and Security

  • You are responsible for your account and credentials. Keep them confidential and notify us promptly of any unauthorized use.
  • We may require verification steps to protect the Service.

5. User Content and License

  • You retain ownership of the content you submit (e.g., ratings, reviews, comments, usernames, avatars).
  • You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, publish, translate, create derivative works (only as needed to operate and improve the Service), publicly perform, publicly display, and distribute your content in connection with the Service.
  • You represent that you have all rights necessary to grant this license and that your content complies with these Terms and applicable law.

6. Community Guidelines & Prohibited Content

  • Do not post content that is illegal, infringing, defamatory, deceptive, hateful, harassing, or that discloses others’ private information.
  • No spam, scams, impersonation, malware, or attempts to artificially manipulate rankings (e.g., bot ratings, vote brigading).
  • We may moderate, remove, or restrict content or accounts at our discretion to protect users and the Service.

7. Acceptable Use

Do not: (a) access or use the Service in a way that could harm, disable, or overburden it; (b) scrape, crawl, or harvest data without our written permission; (c) bypass security or rate limits; (d) use automated means to create accounts or submit ratings; (e) reverse engineer or test the Service except as permitted by law.

8. Copyright Policy (DMCA)

  • We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act.
  • To submit a notice, email viberankio@gmail.com with: (i) your contact info, (ii) identification of the copyrighted work, (iii) identification of the material to be removed and its URL, (iv) a statement under penalty of perjury that you have a good-faith belief the use is unauthorized, (v) a statement that the information is accurate and you are authorized to act, and (vi) your signature.
  • Repeat infringers’ accounts may be terminated.

9. Third-Party Services and Content

  • The Service may link to or embed third-party content (e.g., YouTube videos) or use third-party services (e.g., Supabase, analytics, payment processors). We are not responsible for third-party sites or services.
  • Your use of third-party services may be governed by their own terms and privacy policies.

10. Payments and Subscriptions

  • Some features of the Service may be offered for a fee or on a subscription basis. You agree to pay any applicable charges and taxes described when you sign up for paid features.
  • Except where required by law, payments are non-refundable. We may change pricing or billing practices by posting updates to the Service or otherwise notifying you in advance.

11. Feedback

If you submit ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.

12. Disclaimers

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that ratings or rankings are accurate or free from manipulation.

13. Limitation of Liability

  • TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid to us in the 12 months before the claim.

14. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms.

15. Governing Law; Dispute Resolution

These Terms are governed by the laws of Pennsylvania, without regard to conflicts of laws rules.

16. Termination

  • You may stop using the Service at any time. We may suspend or terminate access for any violation of these Terms or to protect users or the Service.
  • Upon termination, sections that by their nature should survive (e.g., licenses granted, disclaimers, limitations of liability, dispute resolution) will survive.

  • We may update these Terms from time to time. We will post the revised version and update the effective date. Material changes will be notified by reasonable means.
  • Your continued use after changes become effective constitutes acceptance.
